In this article Walker explains the confusing and multifaceted process of claiming and acquiring ownership of land in 1830s Missouri and how that affected the settlement of Joseph Smith and his followers in Daviess County, Missouri. Although Caldwell County was designated as a settlement place for the Mormons, many settled in unsurveyed Daviess County. There they could claim preemption, or squatters rights, once the survey did occur, but not have to pay for the land until the survey. This would allow the impoverished Saints time to acquire the means to pay for their land. Walker believes one explanation for the persecution of the Mormons in this county lies in their neighbors desire to seize the lands which the Mormons had improved. They were able to do this by preventing the Mormons (under threat of violence) from being able to travel to the land sale on the day they could have claimed their preemption rights. This land was then purchased by these key actors in anti-Mormon activities.
